By installing, accessing, or using bots-n-cats ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legal agreement between you ("User", "you", or "your") and bots-n-cats ("we", "us", or "our").

2. Description of Service

bots-n-cats is a GitHub App that transforms your development activity into a live, ambient audio soundtrack. The Service:

  • Receives webhook events from GitHub repositories
  • Generates musical compositions based on development activity
  • Streams audio in real-time to authorized users
  • Provides a dashboard for managing audio settings

3. User Eligibility

To use the Service, you must:

  • Be at least 13 years old (or the age of majority in your jurisdiction)
  • Have a valid GitHub account
  • Have permission to install GitHub Apps on target repositories
  • Comply with all applicable laws and regulations
  • Not be prohibited from using the Service by any previous ban or restriction

4. User Responsibilities

4.1 Account Security

You are responsible for maintaining the security of your GitHub account and any actions taken through it. You agree to:

  • Keep your credentials confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4.2 Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to reverse engineer, decompile, or hack the Service
  • Overload or interfere with the Service's infrastructure
  • Scrape, mine, or extract data from the Service
  • Resell or redistribute the Service without permission
  • Use the Service to spam or harass others
  • Violate any third-party rights (intellectual property, privacy, etc.)

4.3 Content Guidelines

While we don't access your code, you remain responsible for ensuring your repositories don't contain illegal or harmful content.

5. Intellectual Property

5.1 Our Rights

We own all rights to:

  • The bots-n-cats Service, software, and technology
  • Our trademarks, logos, and branding
  • Audio algorithms and synthesis engines
  • Documentation and marketing materials

5.2 Your Rights

You retain all rights to:

  • Your source code and repository content
  • Your GitHub account and data
  • Feedback and suggestions you provide (though we may use them to improve the Service)

5.3 Generated Audio

Audio generated by the Service is not recorded or stored. No ownership rights are transferred for real-time audio streams.

6. Pricing and Payment

6.1 Free Tier

bots-n-cats offers a free tier for:

  • Personal projects
  • Open source repositories
  • Limited usage (subject to rate limits)

6.2 Premium Features

Future premium features may include subscriptions. Terms for paid features will be provided separately.

6.3 No Refunds

All payments for premium features are non-refundable except as required by law.

7. Service Availability

7.1 Uptime

We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is" and "as available."

7.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily interrupts the Service. We will provide notice when possible.

7.3 Rate Limits

We may impose rate limits to ensure fair usage and protect our infrastructure. Excessive use may result in throttling or suspension.

8. Termination

8.1 By You

You may terminate your use of the Service at any time by uninstalling the GitHub App from your repositories.

8.2 By Us

We may suspend or terminate your access if:

  • You violate these Terms
  • Your usage exceeds acceptable limits
  • We detect fraudulent or abusive activity
  • Required by law or legal process
  • We discontinue the Service

8.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease
  • Webhook data will be deleted within 30 days
  • No refunds will be provided (except as required by law)
  • Provisions that should survive termination will remain in effect

9. Disclaimers and Limitations

9.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or uninterrupted.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

9.3 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Third-Party Services

The Service integrates with third-party services:

  • GitHub: Subject to GitHub's Terms of Service
  • Audio APIs: Web Audio API, Tone.js (open source)
  • Hosting: Vercel, Railway (subject to their terms)

We are not responsible for third-party services or their terms.

11. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating formal proceedings, please contact us at support@bots-n-cats.live to resolve disputes informally.

12.2 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
